Terms and Conditions
These terms and conditions ("Terms") govern the use of Rentalkhojo.com ("Platform") by users, whether as Renters or Owners. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
1. User Agreement:
1.1. Users must be at least 18 years old to use the Platform.
1.2. Users agree to comply with all applicable laws and regulations while using the Platform.
1.3. Users are responsible for maintaining the privacy of their account and password. Users are also responsible for all activities that occur under their account.
2. Renting:
2.1. Rentalkhojo.com facilitates rental agreements between Renters and Owners.
2.2. Renters agree to make payments for rental fees and any additional charges through the Platform's designated payment methods.
2.3. Rentalkhojo.com may provide payment processing services through third-party payment processors. However, Rentalkhojo.com is not responsible for any issues or disputes related to payment transactions between Renters and Owners.
3. Listings:
3.1. Owners must provide accurate and truthful information when listing rental properties.
3.2. Owners are responsible for the condition and maintenance of rented items.
3.3. Rentalkhojo.com reserves the right to remove or suspend any listing that violates terms or is deemed inappropriate.
3.4. User agrees that the online advertisements/listings placed with Rentalkhojo shall be reflected after 48 hours. It is to be noted that there can be a likely delay in the posting of a listing, which would be subject to the realization of payment and listing contents. The User further agrees to the stipulated 48 hours processing and the delay as mentioned herein above.
4. Transactions:
4.1. Renters and Owners agree to facilitate transactions, including rental payments and any additional specified fees, through the Platform.
4.2. Rentalkhojo.com may process payments using third-party payment processors.
4.3. Rentalkhojo.com is not responsible for any disputes or issues arising from payment transactions between Renters and Owners.
5. Fraud:
5.1. Rentalkhojo.com is committed to maintaining a safe and trustworthy platform.
5.2. Users are encouraged to report any suspected fraudulent activity to Rentalkhojo.com immediately.
5.3. Rentalkhojo.com does not take any responsibility for fraudulent activities conducted by users on the platform.
6. Ownership:
6.1. Rentalkhojo.com is owned and operated by Bishnoi Assets India Pvt. Ltd.
6.2. Users acknowledge that all content on the platform is the intellectual property of Rentalkhojo.com and protected by copyright laws.
6.3. Users are not permitted to reproduce, distribute, modify, or exploit any content without prior authorization.
7. Independent Verification:
7.1. Rentalkhojo.com does not make any representation or warranty as to the attributes (such as legal title, creditworthiness, identity, etc.) of any of its Users.
7.2. Users are advised to independently verify the bona fides of any particular User that they choose to deal with on the Site and use their best judgment in that behalf.
8. Venue for Transactions:
8.1. This Site is only a venue where Users may meet and interact with one another for their transactions.
8.2. Rentalkhojo.com is not and cannot be a party to or control in any manner any transaction between two Users of the Site.
9. Amendments:
9.1. Rentalkhojo.com reserves the right to amend these Terms at any time without prior notice.
9.2. Continued use of the platform after any amendments constitutes acceptance of the revised terms.
10. Governing Law and Jurisdiction:
10.1. These Terms shall be interpreted and enforced according to the laws and regulations of India without regard to conflicts of law principles.
10.2. Any disputes related to these Terms shall be presented in the exclusive jurisdiction of courts in Jaipur, Rajasthan, India.
11. Limitation of Liability:
11.1. Any interruption or errors in the operation of the Site. You expressly understand and agree that Rentalkhojo.com shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Rentalkhojo.com has been advised of the possibility of such damages).
Prohibited Actions:
In addition to the terms and conditions outlined above, users of Rentalkhojo.com are strictly prohibited from engaging in the following actions:
1. Allowing any unauthorized person(s) to access or use the Service, except for those explicitly named and authorized in the application form.
2. Selling, transferring, or assigning rights or obligations under these Terms & Conditions to any third party. Users are also prohibited from using the Service for any unauthorized commercial purposes.
3. Utilizing the Service for any purpose other than its intended use as subscribed by the User.
4. Copying, downloading, or using any data or personal information for purposes other than renting services posted by Users on Rentalkhojo.com, unless such data or information is posted by the User themselves.
5. Sharing access to the Service with any unauthorized persons without prior written consent from the Company.
6. Engaging in any unlawful activities or criminal behavior while using the Service.
7. Sending or receiving messages or content that is offensive, abusive, indecent, obscene, defamatory, or threatening in nature.
8. Persistently harassing, threatening, or causing inconvenience to any other User or third party on Rentalkhojo.com.
9. Infringing upon the intellectual property rights of any person or entity, including but not limited to copyrights, trademarks, or patents.
10. Using information of other Users for any purpose other than completing transactions on Rentalkhojo.com in which the User is directly involved.
11. Introducing any viruses, worms, or harmful software into Rentalkhojo.com's network system.
12. Engaging in SPAM activities, including sending unsolicited emails or posting unauthorized advertisements that degrade the Platform's performance or availability.
13. Engaging in fraudulent activities or manipulating the service for unlawful purposes.
14. Posting duplicate ads in multiple categories or locations on Rentalkhojo.com.
15. Posting ads that are unrelated to the category in which they are placed, containing inappropriate links, titles, descriptions, or unauthorized use of content.
16. Posting ads soliciting users to post on other classifieds sites or offering services that compete with Rentalkhojo.com's offerings.
Indemnity:
You agree to indemnify and hold Rentalkhojo.com, its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
Arbitration:
Any dispute arising out of or relating to these Terms shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a single arbitrator appointed by Rentalkhojo.com. The seat of arbitration shall be Jaipur, Rajasthan, India. The language of the arbitration shall be English.
Breach:
Failure to comply with any of the terms and conditions outlined in these Terms may result in immediate termination of your access to Rentalkhojo.com without prior notice. Rentalkhojo.com reserves the right to pursue any and all legal remedies available to it in the event of such breach.
Acknowledgment And Acceptance Of Terms And Conditions:
By using Rentalkhojo.com, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in their entirety. If you do not agree to these Terms and Conditions, please do not use the Platform. Your continued use of Rentalkhojo.com after any amendments or updates to these Terms and Conditions constitutes acceptance of those changes.
